I am aware that travel, whether in civilized or remote areas and whether by plane, train, auto, boat or other conveyance, or on bicycle, foot, horseback, or the like, contains some inherent risks of illness, injury or death, which may be caused by negligence of others, physical exertion for which I am not prepared, consumption of alcoholic beverages, forces of nature, or other agents known or unknown. I acknowledge that the enjoyment and excitement of adventure travel is derived in part from the inherent risks incurred by travel and activity beyond the accepted safety of life at home or work, and that these inherent risks I recognize that such risks may be present before, during and after the trip that I am participating in under the arrangements of Culinary Discoveries and its agents or associates. I am aware that medical services or facilities may not be readily available or accessible during some of the time I am participating in this trip.
I understand that Culinary Discoveries reserves the right to refuse any person it judges to be incapable of meeting the rigors and requirements of participating in the activities.
I understand that Culinary Discoveries reserves the right to take photographs or video tapes of any of its trips, and herby agree that Culinary Discoveries may use any such photographic or video tapes for promotional and/or commercial purposes.
The information contained in this brochure is correct to the best of the organizers knowledge, but the organizer accepts no liability for any inaccuracies therein. Culinary Discoveries reserves the right to alter any itinerary or service at any time without penalty.
In consideration of, and as part payment for, the right to participate in the trip, and activities, services and food arranged for by Culinary Discoveries and its agents or associates in connection with the trip, I have and do hereby fully assume all risk of illness, injury, or death, and hereby release and discharge Culinary Discoveries and its agents and associates from all actions, claims, or demands for damages resulting from my participation on the trip. I agree that the foregoing obligation shall be binding upon me personally, as well as upon my heirs, executors and administrators, and all members of my family, including any minors accompanying me.
This agreement will be interpreted according to the laws of the State of California. Jurisdiction over any dispute arising out of this agreement shall be exclusively in the courts of the State of California. If any portion of this agreement is determined by a court to be null and void, the remaining portion of this agreement shall nevertheless remain valid and binding upon the parties.
I have carefully read this agreement and fully understand its contents. I am aware that this is a release of liability and a contract between Culinary Discoveries, and its affiliated organizations, and/or me and sign it of my own free will and in its entirety. I also acknowledge that I have carefully read Culinary Discoveries' Terms and Conditions including its policy on cancelled trips and refunds. I have also carefully read and do agree to this entire Release of Liability and Assumption of Risk and fully understand its contents.
